By creating an account or using Bouquin & Ink ("the Service"), you agree to these terms. The Service is operated by LKM Constructs LLC (aka VesselOS), a North Carolina limited liability company ("we," "us," "our"). If you do not agree to these terms, do not use the Service.
IIWhat Bouquin & Ink is
Bouquin & Ink is a web-based manuscript editor with voice analysis, continuity tracking, and authorship documentation features. The Service is designed as a writing environment. It does not generate manuscript content on your behalf.
IIIYour account
You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating an account. You may not share your account with others or allow unauthorized access. We reserve the right to suspend or terminate accounts that violate these terms.
IVYour content
You retain full ownership and copyright of all manuscripts, notes, world bible entries, fragments, and any other creative work you produce using Bouquin & Ink. We claim no rights to your creative output. We do not use your manuscripts to train AI models without your explicit opt-in consent.
The license you grant us, in plain terms.
- You grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.
- The license terminates the moment you delete your content or close your account.
- We do not claim authorship, ownership, or any creative rights to your work.
- We do not sell, share, or transfer your content to third parties beyond the AI processing described in Section VII.
VVoiceprint
Voiceprint analyzes writing samples you submit to build a voice profile based on sentence structure, vocabulary patterns, and rhythm. This profile is used exclusively to score your manuscript's voice consistency within the Service. Your voice profile is stored with your account and is not shared with other users or third parties. You may delete your Voiceprint profile at any time.
VIIAI features
Some of Bouquin & Ink's intelligence features run on third-party AI infrastructure. When you use those features, the relevant portion of your text is sent to a third-party provider, processed, and the result is returned. Voiceprint scoring is the exception — it runs on our own servers and is not sent to any third-party provider.
Continuity checking, Corkboard synopses, Muse Board prompts, image generation, and world bible entity extraction all send relevant text to a third-party provider to be processed. Your text is not used to train any AI model. After the result comes back, the text is not retained on our side. See our Privacy Policy for full data-handling details.
AI features are tools within the Service — they do not modify your manuscript without your explicit action.
VIIIBYOK (Bring Your Own Key)
If you use the BYOK plan, you provide your own API key for AI processing. We pass your requests through to your chosen provider using your key. We are not responsible for the availability, pricing, data handling, or terms of service of your third-party API provider. You are responsible for understanding and complying with your provider's terms.
IXSubscription, beta, and founding pricing
Bouquin & Ink offers paid subscription plans (Basic, Pro) and a one-time purchase option (BYOK). Subscription fees are billed monthly. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
Beta access is free and limited to 25 founding-tier testers, on a first-come basis. The beta period runs for 30 days from the launch of the beta program, after which beta testers are transitioned to founding-rate billing with at least 14 days' written notice.
Founding-rate pricing. Founding rates extend to the first 100 paying subscribers, including beta testers who continue to a paid plan. Once 100 founding-rate slots are filled, new subscribers pay standard pricing. Founding-rate pricing remains active for the life of a continuous subscription. If a subscription is cancelled and later restarted, current standard rates apply.
Refunds. Refund requests for subscription payments may be submitted within 14 days of the charge. BYOK purchases are non-refundable after 30 days.
Beta-period liability. During the free beta period, our liability cap shall not be less than $50 per claim. See Section XIII for our broader limitation of liability.
During beta, anonymized usage signals contribute to system calibration as described in our Privacy Policy. This is not AI training; it is product calibration to make Voiceprint score writing more accurately.
XData export
You may export your manuscripts, world bible, and project data at any time using the export features within the Service. We will not restrict access to your own content. If the Service is discontinued, we will provide at least 60 days notice and ensure export functionality remains available during that period.
XIAcceptable use
You agree not to:
- Use the Service to produce content that violates applicable law.
- Attempt to compromise, reverse-engineer, or interfere with the Service's infrastructure.
- Abuse AI features in ways that circumvent rate limits or intended usage.
- Resell, sublicense, or redistribute access to the Service.
- Use automated systems to access the Service without our written permission.
XIIAvailability and warranties
We work to keep the Service available and reliable, but we do not guarantee uninterrupted access. The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We are not liable for data loss in the event of catastrophic system failure, though we maintain encrypted backups and reasonable redundancy. See our Privacy Policy for backup retention details.
XIIILimitation of liability
To the maximum extent permitted by law, LKM Constructs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Service. Our total liability for any claim arising from these terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, except as provided in Section IX for the beta period.
XIVChanges to these terms
We may update these terms from time to time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.
XVGoverning law
These terms are governed by the laws of the State of North Carolina, United States, without regard to conflict of law principles.
